Using Im Here!
Im Here! Attendance is a sole proprietorship in Arizona, United States. It runs the Im Here! app at imhereattendance.com and imhere.in. In these terms, "we" and "us" means Im Here! Attendance, and "you" means anyone who uses Im Here!.
- Anyone can check in to a room with a name. Checking in doesn't need an account.
- To sign in, keep saved rooms and room history, or buy Pro, you need to be at least 13. If you're under 18, you need a parent's or guardian's permission to buy Pro.
- If you use Im Here! for a school, company or other organization, you confirm that you're allowed to do so on its behalf, and these terms apply to it too.
- You sign in with Google or with a code we email you. Keep that Google account or email address secure, because whoever controls it can reach your rooms.
- An account is for one person. Don't share it or sell it.
- An account that hasn't signed in for 18 months is deleted, as the privacy policy describes.
Your rooms and fair use
You own what you and the people in your rooms put into Im Here!. You give us permission to store and process it only as needed to run the app for you, as the privacy policy describes. We never sell it.
- When you open a room for a class, team or group, you're responsible for being allowed to collect those names. For schools, that means following the school's own policies.
- Presence checks compare each phone with your room, through a scan of the live board, its location or its network, and flag check-ins that don't match. They aren't definitive proof. A determined bad actor could get around them, so the final call on who was there is yours.
- Names you add by hand count as verified. You're responsible for what you add.
You may not use Im Here! to do any of these:
- Break the law, or harass, threaten or deceive anyone.
- Check in as someone else, or help others do it, unless you're the host adding someone you can see in the room.
- Put spam, ads or offensive content into room names, questions or check-in names.
- Scrape the app, overload it, probe it for weaknesses, or get around its limits.
- Resell or rebrand Im Here! without asking us first.
We may remove content, end rooms, or suspend accounts that break these rules.
Pro and payments
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
- You see the price before you pay. Prices include sales tax or VAT where it applies, and they can differ by country.
- The monthly and yearly plans renew automatically at the end of each period until you cancel. The 6-month plan is a single payment that doesn't renew.
- You can cancel any time from Account, under Plan & billing. Pro stays on until the end of the period you've paid for.
- When Pro ends, nothing is archived or deleted. If you have more than Free's 3 active rooms, you choose which ones to archive the next time you open a room, and archived rooms keep their history.
- If Pro's price changes, the new price applies from your next renewal, and we email you at least 30 days before.
- Refunds follow the refund policy.
What we can promise
Im Here! keeps changing, and features can be added, changed or removed. If a change takes away something Pro included during a period you've already paid for, we refund the unused part of that period. We tell you before changing what the free plan includes.
Like any online service, Im Here! can be interrupted or make mistakes, so it's provided as it is and as available, without warranties of any kind, as far as the law allows. We work hard to keep it running and your data safe.
As far as the law allows, we aren't liable for indirect or consequential losses, lost data or lost profits. Our total liability to you for any claim is limited to what you paid us in the 12 months before it, or $50, whichever is more. Nothing here limits liability that the law doesn't let us limit.
Ending, changes and disputes
- You can delete your account any time from Account. That deletes your saved rooms and room history, and it cancels Pro right away. Read the refund policy before you do.
- We may suspend or close an account that breaks these terms. If we close yours without a good reason, we refund the unused part of any Pro period.
- We may update these terms. When a change matters, we say so on this page and email account holders at least 30 days before it takes effect. If you keep using Im Here! after that, the new terms apply.
- These terms are governed by the laws of Arizona, United States, except where the law where you live gives you rights that can't be taken away. Disputes go to the courts of Maricopa County, Arizona.
Before starting a formal dispute, contact us through the contact page so we can try to resolve it first.
